These Terms and Conditions together with the Privacy Policy which can be found at perchgroup.co.uk/privacy (the "Terms") govern your access to and use of the careers website hosted at careers.perchgroup.co.uk (the "Careers Website") operated by Perch Group Limited (referred to as "Perch Group", "we", "us" or "our"). By accessing or using the Careers Website you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Careers Website.

2. Scope

These Terms apply to anyone who visits, browses, registers for an account, creates a candidate profile, subscribes to job alerts, applies for roles, or otherwise uses the Careers Website. These Terms should be read together with our Privacy Policy, which explains how we collect and process your personal information when you use the Careers Website. 3. Eligibility

You must be at least 16 years old to use the Careers Website. By using the Careers Website you represent and warrant that you are at least 16 years old and have the right, authority and capacity to enter into these Terms.

4. Registration and your account

4.1 Account creation: To access certain features (including applying for jobs and receiving tailored job alerts) you must register for an account and provide accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4.2 Account security: Notify us immediately if you suspect unauthorised use of your account or if your credentials have been compromised by contacting DPO@perchgroup.co.uk or recruitment@perchgroup.co.uk. We will not be liable for losses arising from unauthorised use of your account unless caused by our negligence.

4.3 Information you provide: By creating an account and submitting any information (including CVs, cover letters, references or other materials), you confirm that such information is accurate and that you have the right to provide it. You must not post or upload content that violates any third-party rights.

4.4 Removal and correction: You can update or remove information in your account at any time via your account settings or by contacting us at DPO@perchgroup.co.uk.

5. Use of the Careers Website and candidate obligations

5.1 Acceptable use: You agree to use the Careers Website only for lawful purposes connected to seeking employment, subscribing to job alerts, managing your candidate profile, and related activities.

5.2 Prohibited conduct: You must not:

  • upload or provide false, misleading or fraudulent information;

  • impersonate any person or entity, or misrepresent your identity or qualifications;

  • upload or transmit content that is unlawful, defamatory, obscene, racist, abusive, discriminatory, threatening, harassing or otherwise objectionable;

  • conduct, facilitate, authorise or permit any text or data or web scraping in relation to the Careers Website;

  • upload malware or any disruptive code;

  • attempt to access or interfere with other users’ accounts or the operation of the Careers Website;

  • establish a link to the Careers Website in such a way as to suggest any form of association or endorsement where none exists; or

  • use any part of the Careers Website for commercial purposes without first obtaining a licence to do so from us.

5.3 Consequences: Breach of these Terms may result in suspension or termination of your account, removal of content, and where appropriate, referral to law enforcement.

6. Applications, job alerts and communications

6.1 Applications: When you apply for a role advertised on the Careers Website, your application (including your CV and other supporting materials) will be shared with the hiring Perch Group team or the third-party recruiter named in the job advert, as described in our Privacy Policy.

6.2 Job alerts and marketing: By registering for job alerts or subscribing to communications you consent to receive emails, SMS or other messages from us in accordance with your communication preferences. You may opt out at any time via your account settings or by using the unsubscribe link in any marketing message.

6.3 Third-party adverts and links: Job adverts may link to third-party websites or include contact details for third-party recruiters or employers. We are not responsible for the content or practices of third parties and you should view their privacy notices before sharing personal information with them.

7. Intellectual property

7.1 Our rights: All intellectual property rights in the Careers Website (including the site design, text, graphics, logos, and software) are owned or licensed by Perch Group. You may not reproduce, modify, distribute, sell, or create derivative works from the Careers Website content without our prior written consent.

7.2 Your content: You grant Perch Group a non-exclusive, royalty-free, worldwide licence to use, store, reproduce, transmit and display any content you post or submit to the Careers Website (including CVs and application materials) for the purpose of providing recruitment services. You confirm that you have all rights necessary to grant this licence.

7.3 You agree to indemnify Perch Group against any losses arising directly or indirectly out of or in connection with any materials that you upload to our website that infringe any third party intellectual property rights.

8. Third-party services and links

The Careers Website may use third-party service providers (for example applicant tracking systems, cloud hosting, analytics, email and SMS delivery, assessment providers and background-check providers). Those providers may process personal data under contract with Perch Group Limited or any of its affiliates..

9. Data protection and privacy

Our Privacy Policy explains how we collect, use and share your personal data. By using the Careers Website you acknowledge that your personal data will be processed in accordance with that policy. The Privacy Policy is available at careers.perchgroup.co.uk/privacy.

10. Disclaimers and limitations of liability

10.1 No guarantee of employment: The Careers Website is a platform that helps match candidates to vacancies. We do not guarantee that any job applicant will be offered employment. The creation of an account using our Careers Website does not create an employment, agency, or partnership relationship with Perch Group until a formal employment contract is signed.

10.2 No warranties: The Careers Website and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, except to the extent such warranties cannot be excluded by law.

10.3 The Careers Website may be unavailable from time to time due to maintenance or technical issues and Perch Group shall not be liable for such downtime. We may update and change the Careers Website from time to time as necessary, including where changes are made to meet our business priorities.

10.4 Limitation of liability: To the maximum extent permitted by law, Perch Group Limited, its affiliates and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data, loss of opportunity or business interruption arising out of or in connection with your use of the Careers Website.

10.5 Aggregate cap: Where liability cannot be excluded by law, our aggregate liability to you in respect of any loss or damage arising out of or in connection with these Terms shall not exceed £1,000 (or another amount required by applicable consumer protection laws, where relevant).

11. Termination and suspension

We may suspend or terminate your access to the Careers Website at any time without notice if you breach these Terms, if your conduct adversely affects other users, or if required by law. You may delete your account at any time via your account settings or by contacting DPO@perchgroup.co.uk. On termination we will process any retained personal data in accordance with the Privacy Policy and applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, the revised Terms will appear on this page with an updated effective date. If we make material changes we will notify users who have registered accounts by email where reasonably practicable.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any disputes arising in connection with these Terms, except that if you are a consumer and live in Scotland or Northern Ireland, you may bring proceedings in your local courts.

15.2 Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Assignment: We may assign, novate or otherwise transfer our rights and obligations under these Terms to another Perch Group company or to a third party (including in connection with a sale or reorganisation). You may not assign your rights under these Terms without our prior written consent.
